 GENERAL CONDITIONS OF SALE

1. Acceptance of the general conditions of sale and conclusion of the contract

1.1 The contract stipulated between Kristina Ti Srl and the Customer (ie the subject, a natural person, who makes the purchase on the Site, not referable to his own commercial, entrepreneurial or professional activity) must be considered concluded with the acceptance, even if only partial, of the order by Kristina Ti. In case of non-acceptance of the order, Kristina will in any case give you timely notice to the Customer.

1.2 By placing an order in the various ways provided, according to the order form on the Site, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions.

1.3 These Conditions may be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and by art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.

2. How to purchase

2.1 The only products offered for sale by Kristina Ti are those present on the Kristina Ti website at the time the Order is placed, as described in the relevant information sheets.

2.2 In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but differ for example. by color and size (also due to the browser and monitor used to access the Site and view images).

2.3 In order to place an Order, the Customer must fill out the relevant form on the Site in its entirety and send it after having carefully read the Conditions, as well as the characteristics of the product and / or products he intends to purchase. The Customer must also request Kristina Ti, if desired, to issue a tax invoice relating to the purchase, pursuant to art. 22 Presidential Decree n. 633/1972.

2.4 Correct receipt of the Order is confirmed by Kristina Ti by means of an e-mail reply sent to the e-mail address supplied by the Customer. This confirmation message will summarize the purchase conditions, as required by the applicable legislation, as well as the data entered in the Order by the Customer, so that the same can verify the same and possibly communicate without delay the necessary corrections of incorrect data.

3. Prices and Payment Methods

3.1 The prices indicated on the site are to be considered inclusive of taxes and VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the site or these Conditions.
3.2 The following payment methods are envisaged:

(i) PayPal
For the payment, the Paypal circuit can be used by the customer according to the specific methods of the same.

(ii) Credit Card
In cases of purchase of goods with a credit card payment method, the transaction can take place through the secure Paypal server or other secure server chosen by Kristina Ti.

In no case and at no stage of the payment Kristina Ti will be able to know the information relating to the Customer's credit card, transmitted via a secure connection directly to the website of the bank that manages the transaction. No computer archive of Kristina will keep such data and therefore under no circumstances will Kristina You be held responsible for any fraudulent or improper use of credit cards by third parties upon payment.

4. Delivery of products and related costs

4.1 The purchased products will be delivered to the address indicated by the Customer in the Order within 5-10 working days from the acceptance of the Order by Kristina Ti, at the cost specifically indicated on the Site before sending the Order. Kristina Ti reserves the right to accept or not deliveries requested outside the Italian or European borders. In any case, for deliveries to be made outside the Italian borders, shipping costs and delivery times may vary.

4.2 With regard to deliveries requested in countries outside the European Union, any import customs fees will be borne by the recipient. The Customer is therefore invited to contact the customs authorities of their country in advance to check the costs and any import limits.

4.3 The delivery times indicated by Kristina Ti must be considered as purely indicative and a delay with respect to them, or any delivery made with subsequent split shipments does not entitle the Customer to refuse the delivery itself and to request compensation or compensation.

4.4 Upon delivery of the products, the Customer is required to check:

(i) that the number of packages delivered corresponds to what is indicated in the transport document.

(ii) that the packaging is intact, not damaged, nor wet or otherwise altered, even in the sealing materials (adhesive tape or metal straps).

Any damage to the packaging and / or the product or the mismatch in the number of packages or indications, must be immediately detected, placing a specific indication on the delivery document of the product to be returned to the courier.

Any problems concerning the physical integrity, correspondence or completeness of the products received must be reported within 7 days of delivery, in accordance with the procedures set out in this document.

5.1 Right of Withdrawal and Applicable Law

 Pursuant to Article 52 of Legislative Decree 206/2005
(Consumer Code), as amended by Legislative Decree 21/2014, Customers classified
as consumers have the right to withdraw from the purchase contract concluded
with Kristina Ti, without stating any reason and without incurring any penalty,
within 14 (fourteen) days of receiving the products.

For consumers residing in Italy or other European Union
countries: The Italian Consumer Code and European consumer law apply,
guaranteeing the right of withdrawal under the conditions set forth in this
article, regardless of the destination of the shipment.

For consumers residing in countries outside the European
Union: Kristina Ti does not direct its business activities to non-EU countries.
Contracts concluded with consumers residing in non-EU countries are governed by
Italian law. If you have any questions regarding applicable law, withdrawal
conditions, or return procedures, please contact Kristina Ti at

completing your purchase.

5.2 How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, you must send Kristina
Ti an explicit communication within the specified timeframe to the following
email address: webcustomercare@kristinati.it.

 5.3 Returning Products

If you exercise your right of withdrawal, you must return
the products to Kristina Ti within 14 (fourteen) days of receiving your
withdrawal notification.

The goods must be returned intact, complete in all their
parts and in their original packaging (envelopes and boxes), having been stored
and used only for the time strictly necessary tovestablish and verify their condition, characteristics, and
size, using normal diligence and without signs of wear or dirt, in compliance
with the following conditions:

(i) the right of withdrawal applies to the product purchased
in its entirety; it is not possible to exercise the right of withdrawal on only
part of the purchased product (e.g., accessories, complements, etc.); for the
withdrawal to be accepted, the product must be returned in its original
packaging, complete in all its parts (including packaging and any documentation
and accessories: labels, tags, labels, seals, etc.);

(ii) Return costs:

For orders shipped to Italy and the European Union: the
return costs are €7 and will be deducted from the refund amount;

For orders shipped to non-EU countries: the actual return
costs, communicated to the Customer before the contract is finalized, will be
deducted from the refund amount. 

These costs are the responsibility of the Customer.

(iii) Return shipping is the Customer's sole responsibility
until receipt is confirmed at the warehouse indicated by Kristina Ti;

(iv) If the goods are damaged during transport, Kristina Ti
will notify the Customer so that they can file a complaint with the courier and
obtain a refund. The product will then be made available to the Customer,
canceling the withdrawal request;

(v) Kristina Ti will not be liable in any way for damage,
theft, or loss of returned products during the return shipment.

5.4 Refund

Kristina Ti will refund the Customer the amount paid for the
returned products, net of the return costs indicated above, within 14
(fourteen) days of receiving the notice of withdrawal, using the same payment
method used by the Customer for the initial transaction, unless otherwise
agreed between the parties. 

Kristina Ti may withhold the refund until the returned
products are received or until the Customer demonstrates that they have been
shipped, whichever is earlier.

5.5 Liability for Decreased Value

The Customer is responsible for any diminished value of the
products resulting from handling other than that necessary to establish the
nature, characteristics, and functioning of the goods, in the following cases:

(i) the returned product and/or its accessories and/or
packaging are not intact;

(ii) the product is missing its external packaging and/or
original packaging;

(iii) the product is missing integral parts and/or
accessories (e.g., closures, laces, buckles, etc.).

 In such cases, Kristina Ti may withhold from the refund
amount an amount corresponding to the decrease in value of the product. If the
decrease in value is such that the product is no longer marketable, Kristina Ti
will return the product to the Customer, charging the Customer the shipping
costs and any other costs incurred.

 5.6 Applicable Law

Contracts concluded with Kristina Ti are governed by Italian law.

6. Guarantees

6.1 All products sold by Kristina Ti are covered by a 12 (twelve) month warranty for lack of conformity, pursuant to Title III of Legislative Decree 206/2005. To use the warranty, the Customer must keep the invoice, or the payment receipt, together with the transport document.

6.2 The warranty for lack of conformity will apply provided that the relevant product has been used correctly, in compliance with its intended use and as provided in the instructions for use and washing present in and / or with the product.

6.3 In the event that, for any reason, Kristina Ti is unable to return a product under warranty (restored or replaced) to the Customer, or if the repair or replacement is excessively expensive, also due to the value of the product, Kristina You will be able to proceed with the appropriate reduction of the price paid, ie the refund of the entire amount paid with termination of the contract.

6.4 In cases where the application of the guarantees provides for the return of the product, the same must be returned by the Customer in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment).

8. Privacy

8.1 The personal data collected with the placing of the Order will be processed by Kristina Ti for the sole purpose of satisfying the express requests of the Customer, in compliance with EU Regulation 2016/679 and the privacy policy on the site. Any further processing will be carried out only with the express consent of the Customer.

9. Applicable law

9.1 The sales contract referred to in these Conditions and its execution is governed by Italian law, with the non-application of the conflict rules and the United Nations Convention for the International Sale of Goods. The Court of the Customer's municipality of residence will be competent for the solution of the relative disputes.
